DMCA copyright policy

ProFix Directory respects the intellectual-property rights of others and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512). This policy explains how to send us a takedown notice, how to file a counter-notification, and our policy on repeat infringers.
1. Designated DMCA agent
Send DMCA notices to the designated agent at the address below. Notices that omit any of the elements listed in Section 2 may not be actionable.

A separate DMCA agent designation with the U.S. Copyright Office is being filed; until that designation appears in the public DMCA agent directory, please use the email above. We monitor this inbox during U.S. business hours and acknowledge receipt within 2 business days.
2. Takedown notice — required elements
A valid takedown notice under 17 U.S.C. § 512(c)(3) must include all of the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered, a representative list).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material — a full URL on profixdirectory.com is best.
- Contact information for the complaining party: full legal name, mailing address, telephone number, and email address.
- A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Knowingly making material misrepresentations in a DMCA notice can expose the sender to liability under 17 U.S.C. § 512(f).
3. Response timeline
On receipt of a valid takedown notice ProFix Directory will:
- Acknowledge receipt within 2 business days.
- Expeditiously remove or disable access to the material identified — typically within 5 business days.
- Notify the user who posted the material (if they have a contractor account or contact email) and provide a copy of the takedown notice.
- Document the takedown in our internal log so we can identify repeat infringers (see Section 5).
4. Counter-notification
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g). Send it to the DMCA agent above. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your full legal name, address, and telephone number, and a statement that you consent to the jurisdiction of the U.S. District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which ProFix Directory may be found), and that you will accept service of process from the original complainant or their agent.
If we receive a valid counter-notification we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the material.
5. Repeat-infringer policy
Consistent with 17 U.S.C. § 512(i), ProFix Directory will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers. Three valid takedowns against the same contractor account inside a 12-month window will trigger account termination and removal of the public listing.
6. Public-record content
Most contractor information shown on ProFix Directory (business name, address, phone, license number, complaint history) is sourced from public records — Ohio Secretary of State, state license boards, the Better Business Bureau, U.S. Census, and similar agencies. Public records are typically not subject to copyright. If you believe a public-record entry on ProFix Directory contains a copyrighted photo, logo, or text, follow the takedown procedure above; we will remove the specific copyrighted element and may leave the underlying public-record listing in place.
