These terms ("Terms") govern your use of ProFix Directory ("the directory", "we", "our", "us"), operated by ProFix Directory LLC, an Ohio limited liability company, and reachable at profixdirectory.com. By accessing or using the site you accept and agree to be bound by these Terms. If you do not agree, do not use the site.

1. What the directory is — and isn't

ProFix Directory lists Ohio home-services contractors with public-record verification (license, BBB, complaint history). We are not a contractor, broker, or employer. We do not perform, warrant, or supervise any work. We do not set prices.

Listings are a starting point. Homeowners are responsible for confirming each pro's current license, insurance, and fitness for the job before hiring. Featured and claimed listings are clearly labeled — see how we rank.

2. Homeowner lead submissions

When you submit a job request via the lead form:

• You authorize us to route your request to up to three matched contractors in your area.
• Contact details (phone, email, address) are revealed only to contractors who purchase access to the lead.
• The directory does not contact you outside of fulfillment unless you explicitly opt in.
• Submissions must be genuine work requests. Fabricated or testing leads will be removed and the submitter may be blocked.

3. Contractor accounts and paid leads

Contractors who purchase a lead acquire a non-exclusive, non-transferable license to contact the homeowner about that specific job. Lead pricing is shown at checkout. Subscription pricing for claimed listings is shown on /for-pros.

Refunds follow the refund policy — a 24-hour automatic refund window applies to every paid lead.

Contractors agree to:

• Use lead contact information only for the specific job described.
• Not resell, redistribute, or scrape lead data.
• Comply with TCPA, CAN-SPAM, and Ohio Home Solicitation Sales Act when reaching out.
• Hold current license and insurance for any trade they claim.
• Honor quoted prices and standard industry warranties on any work performed.

4. Listing accuracy and removal

Listings come from public records (Ohio Secretary of State, license boards, BBB) plus contractor-supplied details after a successful claim. Pros may request corrections or removal via /contact. We act within seven business days.

5. Acceptable use

You agree not to:

• Scrape, crawl, or bulk-export listings outside the published open dataset.
• Submit false leads, defamatory reviews, or content that violates Ohio law.
• Reverse-engineer paid features or attempt to access unpurchased lead details.
• Use the directory to harass or solicit homeowners outside the matched-lead workflow.

6. Payments

All payments are processed by Stripe. We do not store full payment card numbers. Disputes filed through Stripe are handled according to Stripe's terms — see also our refund policy.

7. Disclaimer of warranty

The directory is provided as-is, without warranty of any kind. We do not warrant the quality, pricing, timeliness, or outcome of any contractor's work. Verification is a snapshot at the time of listing and not a guarantee of present licensure or fitness.

8. Limitation of liability

To the maximum extent permitted by law, ProFix Directory's total liability for any claim arising out of use of the site is limited to the greater of (a) the amount you paid us in the prior 90 days or (b) US$100. We are not liable for indirect, incidental, or consequential damages.

9. Indemnification

You agree to indemnify and hold harmless ProFix Directory, its operators and affiliates from any claim arising out of (a) work performed or not performed by a contractor you found via the directory, (b) your breach of these terms, or (c) your violation of any third-party right.

10. DMCA / takedown notices

ProFix Directory respects intellectual property rights. If you believe content on the directory infringes your copyright, send a DMCA notice to dmca@profixdirectory.com including: (1) a physical or electronic signature, (2) identification of the copyrighted work claimed to be infringed, (3) identification and URL of the allegedly infringing material, (4) your contact information, (5) a statement of good-faith belief that the use is not authorized, and (6) a statement under penalty of perjury that the information is accurate and you are authorized to act on the owner's behalf. Contractors seeking removal of their public-record listing should instead use /data-deletion or /corrections.

11. Privacy and data deletion

Use of the site is also governed by our privacy policy. To request deletion of personal information, use /data-deletion.

12. Governing law and venue

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Lucas County, Ohio, and you consent to personal jurisdiction there.

13. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remainder remains in effect. These Terms together with the privacy policy and refund policy constitute the entire agreement between you and ProFix Directory LLC regarding the directory.

14. Changes

We may update these Terms. The "Last updated" date above reflects the current version. Material changes will be flagged on the homepage banner for at least 14 days. Continued use after a change constitutes acceptance.
